Whatever happens with Brexit, a knowledge of EU law and its principles has become increasingly relevant for a legal practice in most areas of law. Presuming Brexit goes ahead, the entire acquis of EU law will crystallise and become part of our domestic law on Brexit day, but subject to ministerial powers to re-write areas of law considered to be “deficient”. Lawyers wishing to challenge any unlawful exercise of these Henry VIII powers will not only need to have a solid grounding in public law and judicial review but will also need to understand EU law on Brexit day, as well as EU law and its legal principles as they develop. And even if Brexit is halted in its tracks, there is an ever greater need now to understand EU law in cases involving both domestic and cross-border litigation.
